1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. The definitions apply regardless of whether terms appear in singular or plural.

1.2 Definitions

• Application:The mobile application titled “insulyn,” including all related features, tools, content, and updates.
• Company, We, Us, or Our: Vocata Studio.
• Device: Any device capable of accessing the Service.
• Service: Collectively, the Application, the website, associated software, content, AI-powered tools, and any services offered by the Company.
• User Content: Any images, photographs, text, chat messages, metadata, or other content uploaded, submitted, or transmitted by You through the Service.
• You: The individual using the Service or the legal entity on whose behalf the individual uses the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the insulyn Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.

3. Eligibility

You represent and warrant that You are at least 13 years old. If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.

4. Description of Service

insulyn is an AI-powered food scanning and analysis application designed to help people with type 2 diabetes and prediabetes make more informed food choices. The Service allows You to:

• Scan food items using Your camera or photo library for instant AI-powered analysis
• Receive a traffic light score (0–100) indicating suitability for blood sugar management
• View estimated glucose impact predictions, including blood sugar spike estimates and time to peak
• See detailed nutritional breakdowns including sugar, carbs, fiber, and glycemic impact
• Ask an AI health assistant questions about food, insulin resistance, and dietary choices
• Ask product-specific follow-up questions about scanned food items
• Track scan history and review past food analyses

5. Account Registration

To use certain features of the Service, You must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of Your account credentials
• Notify Us immediately of any unauthorized use of Your account
• Accept responsibility for all activity under Your account

6. Health, Nutrition, and Safety Disclaimers

insulyn does not provide medical advice, nutritional counseling, diagnosis, treatment, or professional health services. The Service is not a medical device.

All food scores, glucose impact predictions, nutritional analyses, traffic light ratings, and AI-generated chat responses are automated approximations produced by artificial intelligence models. They may be incomplete, inaccurate, or unsuitable for Your individual circumstances. Specifically:

• Traffic light scores and glucose impact predictions are approximations only and should not be relied upon as medical guidance
• Blood sugar spike estimates (mg/dL) and time-to-peak predictions are generalized estimates that do not account for Your individual physiology, medications, or health status
• The Service is not intended to diagnose, treat, cure, or prevent any disease, including but not limited to type 2 diabetes, prediabetes, insulin resistance, or any metabolic condition
• AI health assistant responses are informational only and do not constitute medical or dietary advice from a licensed professional
• Individual responses to foods vary significantly based on factors including current medication (insulin, metformin, other oral hypoglycemics), physical activity, overall health, food combinations, portion sizes, and individual metabolism
• You should consult a licensed physician, endocrinologist, dietitian, or other qualified healthcare professional for dietary or medical guidance
• The Company is not liable for inaccuracies in food identification, scoring, glucose impact predictions, or any other AI-generated content
• Do not disregard professional medical advice or delay seeking it because of information provided by the Service
• In case of a medical emergency, contact Your local emergency services immediately

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to analyze food items, generate nutritional assessments, predict glucose impact, and respond to health-related questions. While We strive for accuracy:

• AI outputs may contain errors, hallucinations, or inaccuracies
• Food identification may be incorrect, especially for uncommon items, mixed dishes, or partially visible products
• Nutritional data and scoring may not reflect actual composition of the specific product or portion You are consuming
• Chat responses are generated by AI and may not be factually correct or appropriate for Your situation
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content

You acknowledge and accept these limitations as a condition of using the Service.

8. Subscriptions and Payments

8.1 Free Tier

The Service may offer a free tier with limited usage.

8.2 Premium Subscription

A premium subscription may be available for purchase through the Apple App Store or Google Play Store. The subscription provides additional features including unlimited AI analyses.

8.3 Billing

• Subscriptions are billed through Your app store account on a recurring basis (weekly, monthly, or annually, depending on Your selected plan)
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

8.4 Cancellation

You may cancel Your subscription at any time through Your app store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

8.5 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies.

9. User Content

9.1 Your Content

You retain ownership of all content You submit through the Service, including photos, text entries, chat messages, and scan history (“User Content”).

9.2 License Grant

By submitting User Content, You grant Us a worldwide, royalty-free, sublicensable license to use, store, process, reproduce, modify, and create derivative works from Your User Content solely to operate, maintain, and improve the Service, including internal AI model training. This license survives termination of Your account for content that has been anonymized and incorporated into Our models.

9.3 Restrictions

You agree not to submit User Content that:

• Is illegal, harmful, or offensive
• Infringes on the rights of others
• Contains malware or malicious code
• Violates any applicable laws or regulations

10. Prohibited Uses

You agree not to:

• Upload violent, explicit, or unlawful content
• Reverse-engineer, decompile, or disassemble any part of the Service, or use it for competitive analysis
• Circumvent any usage limits, protections, or access restrictions
• Upload images of individuals without lawful consent
• Access the Service through automated means (bots, scrapers, etc.) without Our written consent
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity
• Use the Service to provide medical advice or services to others
• Redistribute, sublicense, or resell any part of the Service or its AI-generated content

11. Third-Party Services

The Service may include links or integrations with third-party content or services. The Company does not control and is not responsible for such services. Your use of third-party services is subject to their own terms and policies.

12. Intellectual Property

The Service, including its design, features, code, AI models, content, and trademarks, is owned by Vocata Studio and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without Our express written permission.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any food scores, glucose impact predictions, nutritional analyses, or AI-generated content will be accurate, complete, or suitable for any particular medical condition or dietary need.

14. Limitation of Liability

To the maximum extent permitted by law, Vocata Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or bodily injury, arising out of or related to Your use of the Service.

Without limiting the foregoing, the Company shall not be liable for any damages or adverse health outcomes resulting from reliance on AI-generated food scores, glucose impact predictions, nutritional analyses, or health assistant responses.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount You paid Us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Vocata Studio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of Your use of the Service or violation of these Terms.

16. Termination

We may suspend or terminate Your access to the Service at any time, with or without cause, with or without notice. Upon termination, Your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

17. Changes to Terms

We may modify these Terms at any time. Updated Terms become effective when posted. Continued use of the Service after changes constitutes acceptance of the updated Terms. We may notify You of material changes by email or through the Application.

18. Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Denmark.

19. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between You and Vocata Studio regarding the Service.
